What Dam-Smart is — and isn't

Dam-Smart tracks compliance deadlines computed from public state dam-safety records and lets you keep your own inspection and filing history alongside them. Dam-Smart is not affiliated with, endorsed by, or a substitute for any state dam-safety program. It does not submit anything to a state agency on your behalf. Every due date shown is Dam-Smart's own computation from that state's published rule or published record (see each dam's page for the specific rule used) — not a guarantee, and not a substitute for confirming your actual obligation directly with your state program or your professional engineer.

Claiming a dam

Claiming asserts a relationship between your account and a dam in the public inventory; it is not a verified transfer of legal ownership and does not change anything in any state's actual records. Claims can be ZIP-verified against North Carolina's published mailing address where one exists, which is a knowledge check against public data — not identity proof. More than one account may hold a claim on the same dam. Don't claim a dam you don't have a real relationship to.

The compliance-summary PDF

The downloadable PDF is a summary of what's on file and what Dam-Smart has computed — explicitly not the actual state filing, and not a substitute for one. Submitting whatever your state actually requires remains your responsibility.

Accounts

You're responsible for the accuracy of what you submit and for keeping your login credentials confidential. Accounts may be locked after repeated failed login attempts as an anti-abuse measure. Don't use Dam-Smart to scrape, mass-claim, or otherwise abuse the public dataset — automated rate limits exist and may be tightened without notice.

No warranty

Dam-Smart is provided as-is, without warranty of any kind, during this project's pre-launch validation period especially. Statutory deadlines carry real financial penalties (see the pricing page) — always confirm your actual compliance obligation with your state program directly.

Limitation of liability

To the maximum extent permitted by law, Dam-Smart and its operator are not liable for any indirect, incidental, consequential, special, or punitive damages — including fines, penalties, or losses arising from a missed inspection, filing, or compliance deadline, or from a dam safety incident — arising out of or related to your use of Dam-Smart, even if advised of the possibility of such damages. Dam-Smart's total liability for any claim arising from these terms or your use of the service is limited to the greater of (a) the amount you paid Dam-Smart in the twelve months before the claim arose, or (b) one hundred dollars ($100). Nothing here limits liability that can't be limited under applicable law.

Indemnification

You agree to indemnify and hold Dam-Smart and its operator harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the service, your violation of these terms, or your violation of any right of a third party — including a claim that you claimed a dam you had no real relationship to, or that you relied on Dam-Smart's computed due date in place of confirming your actual obligation with your state program or your professional engineer.

Governing law and disputes

These terms are governed by the laws of the state in which Dam-Smart's operator is organized, without regard to conflict-of-laws rules. [Placeholder — state and venue to be filled in by counsel; a pre-launch product like this one hasn't yet fixed where it's incorporated.] Any dispute not resolved informally will be brought exclusively in the state or federal courts located in that jurisdiction, and you consent to their personal jurisdiction.

Changes

These terms may change as the product does. Continued use after a change means you accept the updated terms.
